Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of The Saga of Three Realms (the "Game"), a service provided by Kelsey Roden, doing business as Exhibyte ("we", "us", "our"). By downloading, installing, or playing the Game, you agree to these Terms. If you do not agree, do not use the Game.

1. Eligibility

You must be at least 13 years old to create an account. If you are under the age of majority in your jurisdiction, you may only use the Game with the involvement and consent of a parent or legal guardian.

2. Your Account

• The Game does not use a separate username/password — your account is tied to your Steam account, and you sign in automatically using your existing Steam login.
• You are responsible for maintaining the security of the Steam account linked to your account, and for all activity that occurs under it.
• One account exists per Steam account. We do not currently support merging or transferring accounts between Steam identities.

3. Free Trial

New accounts receive a free trial period (currently 3 days) beginning at your first successful login. No payment is required during the trial. At the end of the trial, continued access to the Game requires an active paid subscription, unless you are participating in an alpha or beta testing period during which the subscription requirement is waived.

4. Subscriptions & Billing

• The Game is offered on a recurring subscription basis, billed monthly or annually as selected at checkout.
• Subscriptions automatically renew at the end of each billing period until cancelled. You authorize recurring charges to your chosen payment method for each renewal.
• You may cancel your subscription at any time. Cancellation stops future renewals; you retain access through the end of the billing period you already paid for.
• We may change subscription pricing from time to time. Any price change will apply to future billing periods only, and we will provide reasonable notice before it takes effect.
• Payments are processed by Paddle.com, acting as our authorized reseller and Merchant of Record for all purchases. Paddle handles billing, invoicing, payment card data, and applicable sales tax/VAT collection on our behalf. Your use of Paddle's checkout is also subject to Paddle's Buyer Terms.

5. Acceptable Use

While using the Game, you agree not to:

• Use cheats, bots, exploits, or unauthorized third-party software to gain an unfair advantage;
• Harass, threaten, or abuse other players;
• Attempt to interfere with, disrupt, or gain unauthorized access to our servers or other players' accounts;
• Use the Game for any illegal purpose, or in violation of Steam's own terms of service.

We may suspend or terminate accounts that violate these Terms, at our discretion, with or without notice.

6. Intellectual Property

The Game, including its software, art, music, and world content, is owned by Kelsey Roden, doing business as Exhibyte, and protected by applicable intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to install and play the Game for personal, non-commercial use, subject to these Terms.

7. Service Availability

The Game is played online and requires a connection to our servers to play. We do not guarantee uninterrupted availability and may perform maintenance, updates, or downtime as needed. We do not guarantee the Game will be available indefinitely.

8. Disclaimers & Limitation of Liability

The Game is provided "as is" and "as available" without warranties of any kind, express or implied. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Game.

9. Termination

You may stop using the Game at any time by uninstalling it and cancelling any active subscription. We may suspend or terminate your access to the Game for violation of these Terms or Section 5 above.

10. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by an updated "Effective date" above. Continued use of the Game after a change takes effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms are governed by the laws of the State of Missouri, United States, without regard to its conflict of laws principles.
